Labour Market Impact Assessments (LMIAs)
Labour Market Impact Assessments (LMIAs)
A Labour Market Impact Assessment (LMIA) is a document which the Employment and Social Development Canada (ESDC) issues to an employer to either authorize or prohibit the employment of a foreign national to fill a particular position. The assessment looks through the records to check if there are capable hands for the job within the Canadian market. The ESDC only grants a positive LMIA when it is satisfied that only a foreign national can fill in the position.
Whether the Labour Market Impact Assessment application is processed by the foreign employee who seeks to be employed, or the Canadian employer who seeks to employ a foreigner, the process always requires legal documentation and procedures.
Foreigners who are not conversant with LMIA applications may not observe the proper processes to apply for and get positive LMIAs. Canadian employers on the other hand are mostly experts in their field. Legal immigration may not be so successful. Thus, only trained legal experts should handle the nitty-gritty of LMIA applications.
